Most consumers do not know this right exists. Even lenders often fail to explain it clearly at the time of disbursement. This guide is written by someone who has been on the drafting side of digital lending compliance documents and can walk you through exactly how the cooling-off period works, when it applies, and how to invoke it if you regret a loan you just took.

What the cooling-off period actually is

Under the Reserve Bank of India’s Digital Lending Directions, in force from January 1, 2026, every borrower who takes a personal loan through a digital lending platform has the right to cancel the loan within a defined cooling-off window. The window is typically 24 hours to 3 working days from the date of disbursement, depending on the lender’s specific policy.

During this window, you can return the disbursed amount without paying any interest. Some lenders retain the right to charge a proportionate one-time processing fee, but the vast majority of the cost associated with a loan (interest, foreclosure charges) is waived if you exit within the cooling-off period.

This is a legally protected borrower right, not a courtesy. The lender cannot refuse or condition the return of funds within the window.

When the cooling-off period applies

The right applies to personal loans, consumer durable loans, and most unsecured retail loans disbursed by RBI-regulated entities (banks and NBFCs) through their digital lending applications or partner platforms.

It applies whether you took the loan through a bank website, a bank app, an NBFC app, or a fintech Lending Service Provider (LSP) that operates on top of a regulated lender.

It does not apply to loans taken through a physical branch process with wet-ink signatures. Those still fall under older contract law where cancellation is possible but conditional on the specific agreement terms.

The 24-hour clock starts from the moment the loan amount hits your bank account, not from the moment you accepted the sanction letter or clicked “I agree”. This is a critical distinction. If your loan is sanctioned at 4 PM on Monday but the disbursement reaches your account at 11 AM on Tuesday, your cooling-off window ends at roughly 11 AM Wednesday under a 24-hour policy, or at end of business Thursday under a 3-day policy. Check the credit entry in your bank statement to note the exact timestamp. Do not rely on the sanction letter date.

How to exercise the right correctly

The procedure sounds simple but has three specific steps that lenders sometimes make deliberately opaque.

First, notify the lender in writing within the cooling-off window. Email to the customer service address listed in your sanction letter is acceptable. WhatsApp messages and phone calls are not adequate proof of notification. Copy the grievance officer email if listed.

Second, transfer the full disbursed amount back to the lender’s designated collection account. Do not attempt to keep the funds “for a few days more” while the paperwork clears. Any delay in the return can be interpreted as continued use, which nullifies the cooling-off protection.

Third, obtain a written confirmation from the lender that the loan has been closed and the account marked as “cancelled within cooling-off period” rather than “foreclosed” or “closed”. This matters because the CIBIL entry created by the loan should be reversed cleanly rather than showing as a closed loan with associated inquiry damage.

What you may still have to pay

The RBI framework does not entirely eliminate cost. Lenders are permitted to charge a proportionate one-time processing fee, typically 0.1 to 0.5 percent of the loan amount, to cover the operational cost of processing your application.

On a Rs. 5 lakh loan, this proportionate fee typically works out to Rs. 500 to Rs. 2,500. Not free, but far cheaper than the roughly Rs. 20,000 to Rs. 40,000 you would have paid if you had run the loan for even three months and then foreclosed.

Some lenders attempt to charge the full processing fee (2 to 3 percent of the loan amount) even within the cooling-off window. This is not compliant with the RBI framework. If challenged in writing with reference to the Digital Lending Directions, most lenders back down. If they do not, the grievance escalates to the RBI Ombudsman.

The CIBIL impact of a cooling-off cancellation

This is the most important question borrowers ask. A cooling-off cancellation does technically create a hard inquiry on your CIBIL file when the loan was originally sanctioned, because the lender pulled your bureau report before approving the loan. That inquiry stays on your file for 24 months and can reduce your score by 8 to 15 points temporarily.

However, if the cancellation is processed correctly with the “cancelled within cooling-off” tag, the loan itself does not appear as a closed account with associated tenure history. This is a cleaner outcome than running the loan for even one month and then foreclosing, which creates both an inquiry and a closed-loan entry.

Some digital lenders attempt to prevent cooling-off cancellations by making the exit process technically difficult, such as removing the cancellation option from the app interface after 12 hours or routing all queries through a chatbot that cannot process cancellations. If this happens, escalate immediately in writing to the grievance officer (mandatory contact listed in every RBI-compliant sanction letter). If unresolved within 30 days, file a complaint on the RBI CMS portal at cms.rbi.org.in. In practice, most lenders resolve within 48 hours once a formal complaint is invoked, because non-compliance with cooling-off provisions carries real supervisory consequences.

When cooling-off is the right call

Three scenarios where invoking the cooling-off right is unambiguously the right decision.

First, if you discover after disbursement that the effective cost is materially higher than what was verbally quoted. Compare the Key Fact Statement APR against what you were told. A gap of more than 100 basis points is grounds for cancellation.

Second, if the intended purpose of the loan no longer applies (the emergency resolved itself, the vendor cancelled, the medical procedure was covered by insurance). Better to eat the small processing fee than run a full-tenure loan you no longer need.

Third, if you find a materially cheaper option from another lender within 24 to 72 hours. A 200 basis point rate difference on a Rs. 5 lakh loan across 4 years is roughly Rs. 22,000 saved. Compare against the small processing fee retention and the choice becomes obvious.

What to do if you already missed the window

If the cooling-off period has already elapsed, your options narrow but are not zero. Standard foreclosure is now the exit route. Foreclosure charges apply for fixed-rate personal loans (typically 2 to 4 percent of outstanding plus GST), though floating-rate loans sanctioned after January 1, 2026 are now free to prepay without penalty.

Model the total foreclosure cost against the interest you will pay if you run the loan to term. In most cases, foreclosing early is still the cheaper decision even after charges. But run the numbers, do not assume.
